01Description of Services

Tripod Studio provides:

• Website design, hosting, and maintenance
• Monthly content shoots (photo and video)
• Social media management and posting
• Google Business Profile management and local SEO
• A 24/7 AI Growth System, which may include an AI chat widget, missed-call text-back, a unified messaging inbox, CRM pipeline management, automated appointment booking, automated review requests, and SMS/WhatsApp follow-up campaigns

Services are provided under a monthly retainer, as described in the package you select (Starter, Growth, or Premium Growth) or as otherwise agreed in writing.

02SMS & WhatsApp Messaging — Use Cases and Consent

As part of the AI Growth System, Tripod Studio may send or facilitate automated SMS and WhatsApp messages on behalf of clients, including appointment reminders, missed-call follow-ups, review requests, and reactivation campaigns.

• Message and data rates may apply.
• Message frequency varies based on client activity and campaign settings.
• Recipients may opt out of SMS messages at any time by replying STOP, and out of WhatsApp messages by blocking the number or replying to unsubscribe.
• Phone numbers and consent records collected for SMS/WhatsApp campaigns are used solely for the purposes described to the recipient at the point of collection and are never sold to third parties.
• Clients engaging Tripod Studio for SMS/WhatsApp automation are responsible for obtaining proper consent from their own customers before those customers are enrolled in automated messaging.

03Acknowledgement

By using tripodstudio.ph or engaging our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and Privacy Policy. If you do not agree, please do not use this website or engage our Services.

04Payment Terms

• Services are billed monthly in advance, unless otherwise agreed in writing.
• Founding client pricing, where offered, is locked in for the first 12 months from the start date of Services.
• Late payments may result in a pause of active Services, including AI system uptime, until payment is received.
• Setup fees, if applicable, are non-refundable once work has begun.
• Either party may cancel a monthly engagement with 30 days' written notice; work delivered up to the cancellation date remains payable.

05Intellectual Property

• Upon full payment, clients own the final website, content, and creative assets delivered specifically for their business.
• Tripod Studio retains ownership of its own tools, templates, workflows, and proprietary automation systems used to deliver Services, and may reuse non-client-specific components across other projects.
• Tripod Studio may showcase completed client work (screenshots, links, and general descriptions) in its own portfolio and marketing unless the client requests otherwise in writing.

06Confidentiality

Both parties agree to keep confidential any non-public business information shared in the course of the engagement, including pricing, customer data, and internal processes, and to use such information only for the purposes of the engagement.

07Disclaimer of Warranties

Tripod Studio does not guarantee specific outcomes such as a defined number of leads, bookings, calls, reviews, or revenue increases. Results depend on many factors outside our control, including market conditions, the client's own responsiveness, and third-party platform changes (e.g. Google, Meta, WhatsApp). Services are provided "as is" and "as available," without warranties of any kind, express or implied.

08Limitation of Liability

To the fullest extent permitted by law, Tripod Studio's total liability for any claim arising from these Terms or the Services is limited to the amount paid by the client to Tripod Studio in the three (3) months preceding the claim. Tripod Studio is not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.

09Governing Law

These Terms & Conditions and Privacy Policy are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any disputes shall be resolved in the appropriate courts of Metro Manila, Philippines.

10Information We Collect

When you use tripodstudio.ph, we may collect:

• Information you submit through our contact form (name, business name, industry, and package interest)
• Information shared with us directly via WhatsApp when you message us

Our contact form does not store your information on our servers — submitting it opens a pre-filled WhatsApp conversation with our team, and from that point your message is handled within WhatsApp under Meta's own privacy practices.

We do not currently use cookies, analytics, or tracking pixels on tripodstudio.ph. If this changes, this policy will be updated accordingly.

11How We Use Information

We use the information you provide to respond to inquiries, discuss and deliver Services, and, for active clients, to operate the AI Growth System tools described above (such as CRM pipelines and automated follow-up) on their behalf.

12Third-Party Services

We may use third-party platforms to deliver Services, including but not limited to WhatsApp/Meta, Google (Business Profile, Analytics, Ads), hosting and infrastructure providers (such as Vercel), and CRM/automation platforms. These providers have their own privacy policies governing how they handle data.

13Data Retention

We retain client and lead information only for as long as needed to provide Services or as required by law. Clients may request deletion of their data by contacting us at the email below.

14Your Rights

You may request access to, correction of, or deletion of your personal information by contacting us at hello@tripodstudio.ph. You may opt out of SMS messages by replying STOP, and out of WhatsApp messages by blocking our number.

15Children's Privacy

Our Services are intended for businesses and individuals aged 18 and older. We do not knowingly collect information from children.

16Changes to These Terms

We may update this page from time to time. The effective date at the top will reflect the most recent revision. Continued use of tripodstudio.ph or our Services after changes take effect constitutes acceptance of the updated terms.
